Im Jahr 1821 forderte dann das „Allgemeine Zunftgesetz“ von den Lehrherren ihrem Gesellen „Gelegenheit zu Schaffen, sich im Schreiben und Rechnen weiter auszubilden, ihn zum Besuche der öffentlichen Zeichenschule und in der Mathematik, wenn in dem Orte dergleichen vorhanden sind und gegeben werden, so wie der Sonntags- und etwa vorhandener Handwerksschule anzuhalten“. Damit waren die beiden Grundelemente der dualen Berufsausbildung vorhanden, wobei eine gesetzliche Verankerung erst viel später stattfand. Daran konnte auch die Industrialisierung im 19ten Jahrhundert nichts ändern. Der vorwiegende Teil der Jugendliche musste ohne eine betriebliche Ausbildung auskommen und diejenigen, die eine solche genossen haben waren eher die Ausnahme. Kerschensteiner, der zu Beginn des 20ten Jahrhunderts aus der bereits existierenden Fortbildungsschule (FBS), die Berufsschule einführte und den Besuch erstmals obligatorisch machte, ist ein in diesem Zusammenhang sehr wichtiger Zeitgenosse. Der Lehrling sollte sich jedoch nicht mehr fachliche Kenntnisse aneignen, sondern die „Verbesserung der staatsbürgerlichen Erziehung“ des Jugendlichen stand dabei im Vordergrund.
